RESOURCES / FAQs

Q:  I have been charged with a DUI.  What should I do now?

A:  It is vital that you contact a respected lawyer with experience in DUI cases as soon as possible. Within 10 days of a DUI arrest, an appeal must be filed to obtain an Administrative License Suspension hearing to protect your license from being suspended.  The state of Georgia will try to suspend a DUI defendant’s license both through the criminal case and through administrative sanction.

New legislation was passed in 2008 changing the guidelines for DUIs, and it is imperative that you plan your defense immediately.  DUI law is the most technical area of criminal law in Georgia, and you should always have the best possible lawyer defending your rights.  Donald Montgomery has been involved in DUI cases as a police officer, as a prosecutor, and now as a defense attorney.  He can now be on your side.  Please call Donald today for a free evaluation of your DUI case.

Q:  I was arrested for a traffic violation, and the officer mentioned that I could be facing time in jail.  What should I do to prepare for my day in court?

A:  It is important to realize that jail time is possible in Georgia on criminal charges, including traffic violations.  You do, however, have a right to a jury trial on all charges, including traffic tickets.   Regardless of the severity of your charges, you need to protect your legal rights, and move forward with the best possible defense team.

Q: My child has been charged with a crime, what can happen to my child?

A:  Dealing with a juvenile criminal case is a serious matter. Your child can be taken from your home and can be detained by the State until the case is adjudicated. The court can keep your child in custody until they are an adult depending on the outcome of the case.  Too many children and their parents try to navigate the juvenile system without representation. Do not risk your child’s future, let us guide you through the juvenile court system.

Please call us today for a free evaluation of your case, and to discuss a strategy for fighting for your rights.
